Airline passengers in Delhi can now breathe easy, and fly easy too! In a landmark judgment, the Delhi State Consumer Commission has observed, that flight delays due to technical snag, or poor maintenance of the aircraft, amount to deficiency in service. However, the Consumer Commission says that delays due to bad weather, poor visibility and bursting of tyres would not amount to deficiency of service.

The Commission has directed all domestic airlines operating from Delhi, to pay a compensation of Rs 10,000 to a consumer, if the flight is delayed by two hours or more, than the scheduled time.

In case of international flights, the amount of compensation will be double, and will be effective if the delay is for more than four hours.

The Consumer Court has clearly mentioned if an airline fails to comply with the order, it shall be liable to pay heavy damages to the passengers. The commission passed the general directive while hearing a petition of a consumer.

The commission in its order states that delays, cancellation of flights and off loading of consumers with confirmed tickets has become too frequent

WOW, This is definitely a landmark decision.

DN will really have to pull itself up or they will go bankrupt pretty soon.

Is this for real? Sounds almost impossible in a country like India, where there are often 1-2 hours of delays just due to airport infrastructure issues. Of course what this means is that airlines should forget about a quick 35 minute turn around at BOM/DEL and instead plan for a 1.5 hour turn around instead, giving them some buffer in the system.

Although I guess the airlines will blame the delays on airport infrastructure and I guess they dont have to pay a fine for that.

The airlines will appeal in a higher court and get a stay order. I don't think the airlines should be penalized for lack of infrastructure at airports and congestions in major airports.

As Himmat pointed out, airlines will definately appeal higher courts and this process will definately cost quite some time and if they don't succeed then they will blame airport infrastructure...

Another development.
A UNI report (Dec. 29) says that a technical snag is no valid reason for flight delay, according to the Consumer Commission.
The normal excuse of ‘‘technical snag’’ for delay of flights has been shot down by a Consumer Commission which asked Deccan Airlines to cough up Rs 75,000 as compensation to two families which suffered more than seven hours delay. ‘If the contention of Air Deccan is accepted, then every service provider will take one excuse or the other and stereotype excuse of technical snag or any other such excuse. Such an insensitive or casual or indifferent attitude shall always leave the consumer high and dry, the Delhi State Consumer Disputes Redressal Commission headed by Justice J.D. Kapoor has said.
The Commision ordered low cost private airlines Air Deccan to shell out Rs 75,000 as compensation to members of two families who were stranded at the Delhi airport owing to flight delays due to technical problem.
The Commission, which also comprised Member Rumnitta Mittal, rejected the airlines’ contention that it cannot be held liable for the delay as they were caused due to problems which were beyond its control.
To keep consumers waiting for hours together without any valid reason and without any direct proof by the service provider that the service could not be provided well in time as per contract due to reasons which were beyond their control amounted to deficiency in services, it said, dismissimg two appeals of the airlines which were filed against the orders of a District Consumer Forum.
Upholding the consumer forum’s verdicts, the Commission awarded travellers Gurpreet Singh and Rakesg Kwatra and their family members a consolidated compensation of Rs 75,000.

Technical delay beyond 15 minutes requires a detailed explanation to DGCA.The Airlines ESR will be stating same.Alert value will rise.No Airline would use Technical delay >15mins as an Excuse to pacify pax & save on HOTAC.
Techincal Delays are more expensive to the Airlines repution & pockets.
